Solar Trader’s services facilitate the purchase and/ or sale of third party goods. We connect buyers and sellers of products, however we do not own, sell or purchase products.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
(a) to cancel your service contract with us; and
(b) to a refund for the unused portion, or to compensation for its reduced value
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the subscription.
Our website contains intellectual property (including copyright) owned by Solar Trader and third parties.
We and our third parties retain all rights, title and interest in our website and all related content. Nothing you do on or in relation to the website will transfer to you:
(a) the business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright; or
(b) the right to use or exploit a business name, trading name, domain name, trade mark or industrial design; or
(c) a system or process that is the subject of a patent, or copyright (or an adaptation or modification of such a system or process), of Solar Trader or any third party.
You warrant that we will have the right to display or otherwise use any intellectual property that you send to us, display on or communicate through our website and that any such use will not infringe the rights of any person.
When you come to our website solartrader.com.au we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.
You must only use our website for lawful purposes. You must not: carry out any activities in relation to our website:
(a) that may cause disruption or failure of the website or any part of it, including its functionality;
(b) that may constitute infringement of our intellectual property rights;
(c) provide false information when submitting an order or corresponding with us, or any related seller institutions;

In such case, you will not be entitled to a refund of the listing or promotional fees you have paid.
To the fullest extent permitted by law, we exclude all representations, warranties, implied terms (including those implied by statute, custom, law or otherwise) in relation to our website, except as expressly set out in these terms. We are not liable to you in respect of any claim in relation to our website or these terms for any loss, damage, expense, loss of data or other incidental damages.
When visiting our website or social media pages, and subject to your compliance with these terms, you may post reviews and comments.
If your reviews or comments contains defamatory, misleading or false statements or is threatening, aggressive or contains obscenities, or is otherwise contrary to the relevant social media platform’s content or other rules, we may remove your reviews and comments and remove your access to our website and social media pages.
We reserve the right to remove or edit any content that you post on our website. You acknowledge that any content posted by you on our website or social media pages becomes our property. We do not store any credit card information that you provide. If payments are made via our website, they are securely managed by our third party payment gateway vendor.
You may use and link third party payment gateway vendors such as PayPal or Stripe, Stripe Connect etc. on our website to complete transactions.
When you link a third party payment gateway to your account, you can use your third party payment gateway to pay or be paid for products while using Solar Trader. You acknowledge and agree that by utilising any third party services through our website (such as PayPal, Stripe, Stripe Connect), you are bound by the terms and conditions of that third party and we are not liable for any loss, claims or damages, howsoever arising in connection with that third party’s services.
If you link any third party payment gateway to your account, you appoint Solar Trader as your limited agent to the extent required to:
(a) provide to the third party payment gateway your name, address, mobile number, payment amount, item details, item category, and all other information required to enable the third party to process payments to or from your third party payment gateway account; and
(b) receive a payment confirmation and decline notices from the third party payment gateway in respect of your third party payment gateway payment transactions.
Our appointment as your agent to undertake these activities terminates immediately upon your account ceasing to be linked to your third party payment gateway account.
If you are in dispute with third party payment gateway, a buyer, or a seller, that does not arise directly as a result of Solar Trader’s negligence, in respect of any payment transacted (or failed to be transacted) on your third party payment gateway account, you release us and our affiliates (and our officers, directors, agents, subsidiaries, joint ventures and employees and those of our affiliates) from any and all claims demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.
Solar Trader is not able to access your complete financial details from the third party payment gateway account. At no time does Solar Trader hold any of the funds when a buyer pays a seller using a third party payment gateway. Funds are transferred directly from the buyer’s Account to the seller’s Account after the deduction of any relevant fees.
The third party payment gateway provider’s terms and conditions may apply to you when you access third party payment gateway services from our services. You acknowledge and agree that, to the extent permitted by law, we are not liable to you for any loss or damage you incur arising from your use of any third party payment gateway method unless such loss or damage was as a direct result of Solar Trader’s negligence, in which case our liability is limited to the reperformance of our services or a refund.
We make every attempt to ensure that the website is free of viruses and other malicious code which may affect your computer systems. However, your access to and use of the website is at your own risk and you must take your own precautions to avoid and protect your computer systems against any viruses and other malicious code.
You acknowledge that we are not liable if, due to events beyond our reasonable control, you incur any loss or damage arising from a cyber security event in relation to our website, email communications, payment gateway providers or services.
You must take appropriate steps to ensure that any requests for payment purporting to be from Solar Trader are genuine, including by calling or emailing us to request confirmation.
When you visit our website, purchase goods or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on our website.
You acknowledge that you are solely responsible for verifying that any electronic communications do not contain any viruses and have not been subject to compromise. If you receive an invoice electronically, you must verify any account details described in that invoice.
In order to list your products, services or job vacancies on our website as a classified advertisement, you must pay the listing fee. Listing fees vary depending on the package you select, whereby there may be advertisements which do not incur cost from time to time. Our fees are quoted in Australian dollars and are subject to change. We will notify you of changes to our fees by posting on our website. You may select additional paid promotions to enhance your advertisement, which may incur additional cost.
You indemnify and irrevocably release us from any loss, cost, damage or expense (including legal costs on an indemnity basis) that we incur and that arises out of or in connection with your breach of these Terms or a third party claim made against us that is caused by your advertisement (regardless of our review or acceptance of that advertisement to be placed on our website).
When you post advertisements on our website, either as classified ads, to advertise job vacancies or to sell products or services through our website and collect payment through our website, you agree to comply with our posting rules (as detailed below). Advertisements that breach our posting rules may be removed from our website with or without notifying the owner of the removal, at our discretion. No refund will be given for the fees paid to list the advertisement.
It Is the responsibility of the advertiser before posting an ad on Solar Trader to ensure that content advertised adheres to Solar Trader’s posting policies as well as Australian applicable laws. As a condition of your use of Solar Trader specified under our Terms and Conditions, you agree that you will not violate any laws.
You warrant that any advertisements posted on our website:
(a) do not breach Solar Trader posting rules;(b) do not breach Australian law; (c) relate to the solar PV, hot water or Renewable energy industry;(d) do not include external links or wording or tags that may negatively impact Solar Traders’ search engine optimisation;(e) do not harm our website or in any way damage our reputation;(f) will be posted in English;(g) are not posted from outside Australia, or from behind a VPN – Solar Trader is for Australian based users only;(h) do not include external links (other than links that refer to the products manufacture website and are meant to give the potential buyer more information about the product being offered); (i) are sufficiently descriptive and do not include misleading information or statements about the product you are offering;(j) do not contain inappropriate language, photos or images; (k) are discriminatory in nature, of any kind; and(l) are not fraudulent.
If your advertisement expires or is removed from our website for any reason, all related images, documents, videos, and chat communications will be deleted from our server within 30 days after expiry or removal, unless we are required by law to retain them for a longer period of time.
We recommend that you retain copies of any materials you wish to keep related to your advertisement before it expires or is removed from our website. We will not be liable for any loss or damage arising from the deletion of your advertisement or related materials following expiry or removal.
You may purchase advertising space in the form of banners and popups on our website. This advertising space is intended for:
(a) promoting brands, products and businesses, other than products that are advertised and sold through classified ads or ads sold through the website;

Any advertisements on our website requires our approval and we reserve the right to refuse advertisements for any reason and in our sole discretion.
Our website was created as a platform to bring buyers and sellers of new, refurbished, second hand and obsolete equipment, tools and materials from within the renewable energy industry together.
It is therefore the aim of this website to only list advertisements that relate to the renewable energy industry. If your advertisement falls outside of this aim, we may remove your advertisement.
