Solar Trader is a platform facilitating the listing of advertisements, classified advertisements, purchase and/ or sale of third party goods. Solar Trader does not make any warranties or guarantees with respect to third party goods sold through solartrader.com.au.
These terms apply to users of our website that list, buy, or may buy, products through our website.
You can place an order for products that are advertised for sale by sellers on our website by visiting solartrader.com.au.
The prices of sellers’ products are displayed on our website.
We ask sellers to maintain accurate information on our website, but from time to time there may be an error. If the purchase price is more or less than the price displayed, you must contact the seller directly.
We ask sellers to display live information about stock availability. However, from time to time there may be issues with third party platforms or other errors which may impact the accurate display of stock availability. You must contact the seller directly with respect to any stock availability.
Solar Trader cannot cancel or modify your order on your behalf.
Any request to modify or cancel your order should be directed to the seller from whom you purchased a product.
Solar Trader is not responsible for shipping times, delays, or costs.
Shipping is managed by sellers.
If you have any questions regarding shipping or wish to discuss changing your shipping details, shipping costs or shipping delivery timeframes (including any delays to your order), you must contact the seller directly.
Refunds and returns (including any conditions that may apply) are not accepted by Solar Trader.
You acknowledge that nothing in these terms is intended to, or does, create a binding contract between Solar Trader and any person who buys or seeks to buy any product(s) through our website.
You are responsible for taking steps to confirm the identity of any seller that you communicate with or from whom you seek to purchase product(s). You acknowledge that we do not vet or take steps to confirm the identity of sellers.
These Terms and Conditions apply to users, including sellers, that use our website to promote or sell products.
A contract is entered into between Solar Trader and a seller when we accept, either in writing or by conduct, a request to adverse products through solartrader.com.au.
This contract (which means the Terms That Apply to Selling Products, the Privacy Policy and the Website Terms of Use) constitutes the only agreement governing the use of our website by sellers and supersedes all previous communications, negotiations or agreements in connection with the use of our website by sellers.
Except as specifically provided in this contract, any terms in respect of the use of our website by sellers contained in or relating to any other documents, including any of your documents (even if they are specified to prevail), are excluded. By making a request to use our website, sellers acknowledge that these terms and conditions prevail over any other documents or terms.
You warrant that you will:
(a) take all steps necessary to ensure all information regarding the products that is displayed on our website or communicated to us or a buyer, is accurate, complete and not misleading or deceptive;
(b) immediately update any product information if the condition, quality or other characteristics of a product change while they are displayed on our website;
(c) communicate with buyers in a way that is professional and courteous;
(d) not use profanity or other offensive language, or behave in a manner that discourages a buyer from using our website; and
(e) comply with any law, including those applying to the sale, packaging, delivery and advertising of the products you sell through our website.
You indemnify and irrevocably release us from any loss, cost, damage, or expense (including legal costs on an indemnity basis) that we incur and that arises out of or in connection with your breach of the contract or a third party claim made against us that is caused by you or your product(s).
You acknowledge that:
(a) we do not verify the identity of any buyers and you must satisfy yourself as to the identity of any person with whom you communicate or sell any product(s);
(b) our liability for any loss, damage, cost or expense of any nature, and to the extent not prohibited by the Australian Consumer Law, is limited to $100; and otherwise
(c) our liability for defective services (being the use of our website) is limited to the resupply of those services or a refund for the price paid for those services.
We are not liable for any consequential or indirect loss, including loss of profit, loss of revenue, loss of opportunity, loss of contract, loss of production, increased financing costs or loss of reputation, howsoever arising.
You must pay for the use of our platform
If, you sell directly through (including by a listing as a classified ad) and use our website to collect payment from a buyer, on receipt of payment from the buyer:
(a) 95% of the gross sale price will automatically be sent to your account using our third party payment gateway;
(b) we will retain 5% (or such other percentage we state in writing at the time you request to use our website to sell products) of the gross sale price; and
(c) If you sell through our website, you must not request, require or otherwise procure a buyer to make a payment for the products other than through our website and agree to indemnify us for any loss we incur if you breach this clause.
Except to the extent a refund is required under the Australian Consumer Law, our fees and costs are non-refundable.
We will have no liability to you in relation to any loss, damage or expense caused by any failure or delay in providing the services as a result of fire, flood, tempest, earthquake, pandemic (including COVID-19), epidemic or other acts of God, riot, civil disturbance, theft, crime, strike, lockout, breakdown, war, any software, platform or payment gateway issues or any other matter beyond our control.
Any provision in these terms and conditions which is invalid or unenforceable in any jurisdiction must be read down for the purposes of that jurisdiction, if possible, so as to be valid and enforceable. If that provision cannot be read down, then it is capable of being severed to the extent of the invalidity or unenforceability without affecting the remaining provisions of these terms and conditions or affecting the validity or enforceability of that provision in any other jurisdiction.
You acknowledge that the laws of Queensland, Australia, without regard to principles of conflict of laws, govern your use of our website and the products we sell to you.
